You bought a condominium


Congratulations! You’ve bought a condominium protected by the APCHQ’s GMN.

As of January 1st, 1999, pursuant to government decree, all new residential buildings constructed in Québec must be covered by a guarantee plan overseen by the Régie du bâtiment du Québec (RBQ).

The Association provinciale des constructeurs d’habitations du Québec’s (APCHQ) Garantie des maisons neuves (GMN)* is a private administrator of this mandatory New Home Gurantee Plan. The APCHQ’s GMN provides a warranty covering certain legal and contractual obligations of the building contractor pursuant to the Québec Regulation Respecting the Guarantee Plan for New Residential Buildings.

Documents to fill out and keep in a safe place

Under the Regulation, your contractor, who is accredited by the APCHQ’s GMN, is legally bound to register your new condominium and proceed, with you, to its acceptance. For these two key processes, you will be asked to complete the following steps:
  1. Jointly with your contractor, complete a Preliminary Contract and the APCHQ’s GMN Guarantee Contract - Building Held in Divided Co-Ownership. If it has not already been done, your contractor will register your contract (when signed) with the APCHQ’s GMN. It will then send you the Certificate of Registration of a Building within a month’s time.

  2. Sign the form entitled Certificate on Account as soon as you have paid an instalment toward the purchase of your unit.

  3. Upon delivery of your unit, you must declare its acceptance by completing the Pre-Acceptance Inspection Form, which lists the elements to be verified at the time of the pre-acceptance inspection. Each unit must be inspected before acceptance.

  4. You will receive the Declaration of Performance of Work, but only once your contractor has completed the final work indicated in the Pre-Acceptance Inspection Form, unless no such final work was indicated.

Important notice regarding the acceptance of the common portions

After the end of work on the common portions of the building, your contractor will complete the following documents:
  1. The Notice of End of Work on the Common Portions of the Building, which indicates the date of end of work as well as the upcoming inspection by a professional who has been mandated by the syndicate of co-owners to proceed to the acceptance of work on the common portions.

  2. The Pre-Acceptance Inspection Form (common portions) completed jointly with the building professional and the syndicate of co-owners.

  3. The Confirmation of Finishing of Minor Works, if required.
Make sure you keep copies of all these documents in a safe place.

As the beneficiary of the New Home Guarantee Plan, it’s your duty to be well informed! To that end, we remind you that it is important to carefully read the brochure that explains the Regulation published by the Régie du bâtiment du Québec (RBQ). The APCHQ’s GMN will send you a copy of the brochure along with your Certificate of Registration of a Building. It explains the terms and conditions of the guarantee plan in detail, as well as what you must do at each key step in the process of purchasing your new condominium.

It contains a detailed list of the care and maintenance work your home will require, along with how-to explanation and a description of the adjustments you should expect.
